Defendly is a consumer rights automation platform that helps users document potential TCPA and FDCPA violations, generate demand letters and related documents, track claims, and connect with attorneys. We are not a law firm. We do not provide legal advice. Our tools and content are for informational and educational purposes only. You are responsible for your own decisions and for seeking legal counsel when appropriate.

Use License

Permission is granted to use Defendly for personal, non-commercial consumer protection purposes in accordance with these terms. This license does not include:

  • Modifying, copying, or redistributing our materials
  • Using materials for commercial purposes without our authorization
  • Removing copyright or proprietary notations
  • Transferring access or materials to another person in violation of these terms

User Accounts

To use certain features, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and complete information
  • Notifying us immediately of any unauthorized use

Violation Documentation and Demand Letters

When you use our platform to document violations or generate demand letters and other documents:

  • You represent that the information you provide is accurate to the best of your knowledge.
  • You understand that generated documents are templates or drafts and have not been reviewed by an attorney for your specific case.
  • You are responsible for reviewing and approving any document before sending it; we are not responsible for errors or omissions.
  • We do not guarantee any outcome from sending demand letters or pursuing claims.

User Responsibilities

When using this service, you agree to:

  • Provide accurate information
  • Maintain the security of your account credentials
  • Use the service in good faith and in compliance with these terms
  • Not use the platform to harass others or for any illegal purpose
  • Seek professional legal advice when you need legal guidance

Prohibited Activities

You agree not to:

  • Use the platform for any illegal purpose
  • Post false, misleading, or fraudulent information
  • Interfere with or disrupt the platform's operation
  • Attempt to gain unauthorized access to any part of the platform
  • Harass, abuse, or harm other users
  • Use the platform in a way that violates any applicable law or third-party rights

Limitation of Liability

Defendly is provided "as is" without warranties of any kind, express or implied. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to:

  • Any outcome of claims, demand letters, or legal proceedings
  • Reliance on information or documents provided by the platform
  • Errors, inaccuracies, or omissions in our content or tools
  • Decisions you make based on our platform

Our total liability to you for any claim arising from these terms or your use of the platform shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

Dispute Resolution and Arbitration

Any dispute arising out of or relating to these terms or the platform shall first be addressed through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, either party may elect to resolve the dispute by binding arbitration administered in accordance with applicable arbitration rules. You waive any right to participate in a class action or class-wide arbitration. This section does not prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.

Changes to Terms

We reserve the right to modify these terms at any time. We will indicate the date of the last update. Your continued use of the platform after changes constitutes acceptance of the new terms. If you do not agree to the updated terms, you must stop using the platform.
