Defendly is provided "as is" without warranties of any kind, express or implied. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to:
Our total liability to you for any claim arising from these terms or your use of the platform shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
Any dispute arising out of or relating to these terms or the platform shall first be addressed through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, either party may elect to resolve the dispute by binding arbitration administered in accordance with applicable arbitration rules. You waive any right to participate in a class action or class-wide arbitration. This section does not prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.
